1. Registration, User account

2.1.By finishing registration a licence agreement to these terms is made between the user and on4news.
2.2.Opposing or from these terms deviating conditions of the user have no validity.
2.3.Online services are rendered visible by advertisers or online partners, their Terms and Conditions shall prevail.
2.4.on4news has the right to change or adapt the conditions during the membership. on4news will announce the changes to the terms and conditions four weeks before they take effect. If the user does not disagree within four weeks, the changes take effect. In the announcement on4news will indicate the user to his right of objection and on the consequences if there is no objection. If the user objects the conditions, on 4news has the right to terminate the contract immediately, when the conditions taking effect. If there is no cancellation then theagreement between the user and on4news continue with the previous contractual arrangements.
3. Dealing with passwords
3.1.The user has to keep his password in secret, store it safely and make it inaccessible to unauthorized people. This permission applies only to the user and is not transferable.
3.2.If the passwordis known from any unauthorized person, the user has to inform on4news immediately by e-mail or writing. The old password will getl ocked and a new password assigned. The user is not entitled to provide his account to unauthorized people ora third party. The user acknowledges that he is also responsible for the actions of a third party to whom he provides his user account.
4. Content of the site and extent of use
4.1. on4news aggregates daily actual positive news from all over the world.But on4news has no own editorial department. All goodnews are written by our users or collected from appropriate and freely available internet sources and linked on on4news. These messages can be read, rated, commented and forwarded to interested parties by other users. Every registered user also receives, in the sense of a community, the opportunity to create an own profile, build a network with other users and contact them.

4.2. on4news provides registered users the following options:
4.2.1. Setting or linking positive messages that have been self-created or found in freely accessible Internet sources and the author's consent has been obtained for their publication, copying and public disclosure, if it is a copyrighted work;
4.2.2. Read, rate, comment and passon goodnews;
4.2.3. Creation of your own public profile page (also indexedby search engines), that shows the news-activity of the user (providing, voting, commenting, et cetera) and offers the opportunity to make voluntary personal information (including upload an image). The profile can be importeddirectly from the Facebook profile, too.
4.2.4. View or changepersonal information and account settings (e.g. administration of your password or your alternate e-mail address) in "My Profile";
4.2.5. Building your own network / group of friends with other on4news users;
4.2.6. Contact with members of the local network via an internal message system;
4.2.7. Find messages and other members;
4.2.8. Subscription ofgood news via RSS feeds and email newsletters.
4.3. Non-registeredusers can read good messages on on4news.
5. Availability
5.1. on4news tries to keep the offer available at all times. on4news does not warrant that the website is always available and free of errors or suitable for a particular purpose. If there is data loss for the user because of malfunctions, maintenance or enhancements there is no claim for compensation. Also for unavoidable, unforeseeable and extraordinary events that may lead to non-availability of the offer, such as Power failures, hacking, or failure of telecommunications lines on4news assumes no responsibility. The use of on4news is at your own risk. This also applies to the case that by downloading or other use of content damage results e.g. on technical equipment or data loss occurs. This also applies to any damages to third parties.

6. General obligations of the user
6.1. Statements in news, comments, messages, etc., should follow the rules of a polite and respectful contact with each other. Criticism and opinions should be expressed constructively.
6.2. The user agrees not to violate the applicable statutory provisions and the contractual terms. He may use on4news only in the context of the presumed purpose. Any misuse, beyond this earmarking, is forbidden to the user, these include in particular the following actions:

6.2.3. Any actions that lead to excessive loads or to system disorders, or intended or suitable to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
6.2.4. Systematicreading of the personal data of other users and modifying, copying, or distribution of areas of the site that are not allocated for that purpose by on4news.
6.2.5. The use of other identities for the registration, placing posts or the sending of messages. This also refers to feign a membership on the on4news team or a relationship with a particular person;
6.2.6. The manipulationof news and content to disguise the origin of any Content.
6.3. Each of the aforesaid breaches of duty entitles on4news to terminate the contract immediately, to block the user accounts and delete the presented contents. Furthermore on4news is entitled to refuse the activation of a new account for this user.
6.4. The user must ensure that by posting content (messages, texts, images, photos, videos, names, trademarks, etc.) he will not infringe rights of third parties (in particular copyrights, privacy rights, including the portrait rights, trademark rights). He also has to ensure that the applicable criminal laws and youth protection regulations are observed and in particular no unsuitable or criminal content for young people are distributed. Also, the user must not post any content he is not entitled to pass on. on4news respects the intellectual property of third parties and claims no rights to the uploaded content.
6.5. The user agrees to the protection of data to contribute with the recognized principles of data security and comply with the obligations of the Privacy Policy. The user will indicate evidence of improper use of the contents towards on4news immediately.
6.6. The user is liable for all consequences and disadvantages, arising on4news by improper or illegal use of the site or through the violation of other fundamental contractual obligations. The user releases on4news from all claims of third parties at the first request, which these claim on on4news in matters of an infringement, caused by the user or contents placed by the user. The user carries all necessary costs of legal defense in this matter. The user agrees to assist on4news in defending against such claims.
6.7. on4newsis entitled to delete or disable contents posted by users if they violate the rights of third parties or third parties assert claims due to a violation of law, whose merits cannot be excluded obviously.
7. Terminationand cancellationof useraccounts
7.1. The user is entitled to terminate the contract with on4news at any time without giving any reasons and without any notice period. The termination has to be in written form. In case of termination, the user profile gets deleted, but on4news can decide to keep the published articles and other publish contents without a link to the former profile.
7.2. on4news is entitled to terminate the contract with a notice of one month to the end of the preceding month.
7.3. on4news can exercise its right of a notice of cancellation and a deletion of the profile, when the user did not sign in for at least a year and did not answer to a reminder.
7.4. on4news is entitled to cancel the contract without notice, when there is a important reason. An important reasonexists in particular,
7.4.1. If the user violatesits contractualobligations;
7.4.2. If the user breaches against statutory provisions while using on4news.
7.5. In the caseof paragraph 7.4 on4news is entitled to delete the user account immediately without notification of termination and to oppose the installation of a new account for this user.
7.6. A termination according to these terms and conditions must be in written form, whereat an e-mail is sufficient.
8. Liability
8.1. on4news has unlimited liability regardless of the legal basis
8.1.1. In case of intentor grossnegligence,
8.1.2. According to the provisionsof the Product Liability Act, as well as
8.1.3. For injury to life, bodyorhealth.
8.2. With slightly negligent breach of a duty, that is essential to achieve the contractual purpose (cardinal obligation), the liability of on4news is limited to the damage, that is predictable and typical for the type of business, but not for other special damages or consequential damages (e.g. lost profits, business interruption, loss of business information).
8.3. A further liability of on4news does not exist.
8.4. For the negligenceof vicarious agents and representatives on4news shall be liable to the same extent.
8.5. on4news is not liable for the possibility and quality of accessibility, the quality of representation, for memory loss, interruption, any delay, cancellation and transfer errors in communication - except in cases of deliberate intention or gross negligence.
